These Beta Testing Terms and conditions govern your access to and use of the beta software and services related to Finqalab (a project of Next Capital Limited) (“Beta Software”). The Beta Software is a version of the software that has not yet been released to the general public and is not available for commercial use.

“Finqalab” (a project of Next Capital Limited) (“Finqalab”), at its sole discretion, may offer the Beta Software during the beta testing phase to selected, interested customers for the purposes of testing the functionality of the Beta Software. If you use a product or service during beta testing, you are asked to provide feedback and input to Finqalab and assume all risks associated with the Beta Software.

Finqalab advises all beta users to use extreme care when beta testing software since beta software is subject to strict confidentiality and the quality of the software is still under evaluation.

By downloading or using Finqalab’s Beta Software, you expressly agree to the following terms and conditions. If you do not agree to any provisions contained herein, you must not download or immediately discontinue any use of the Beta Software.

You acknowledge and agree that Finqalab offers beta software “as is” without warranty of any kind, express or implied, and subject to the terms contained in these terms & conditions.

1. You acknowledge and agree that Finqalab offers beta software “as is” without warranty of any kind, express or implied, and subject to the terms contained in these terms & conditions.
2. You agree, that during the testing phase of the Beta Software, Finqalab grants to you a limited, non-transferable, non-exclusive, revokable right to access and use the Beta Software to test its functionality and provide feedback to Finqalab. Finqalab reserves the right, in its sole discretion, to revoke access and use of the Beta Software at any time. Further, Finqalab reserves the right to as maybe needed to (i) monitor or measure use of the Beta Software; (ii) validate certain features or functionality of the Beta Software; and (iii) to provide services or support necessary to maintain the Beta Software
3. You acknowledge and agree that Beta Software may not operate properly, be fully functional or be in final form.
4. You acknowledge and agree that Beta Software may contain glitches, flaws, design flaws, errors and / or other implications
5. You acknowledge and agree that the use of Beta Software may result in corruption or loss of data, unexpected results, unpredictable and unforeseen loss or damage.
6. You acknowledge and agree that Next Capital has no obligation to release a commercial/final version of the Beta Software.
7. You acknowledge and agree that you will assume all risks arising from using the Beta Software.
8. Finqalab shall have no obligation to maintain, correct, update, change, modify, or otherwise support the Beta Software.
9. Finqalab may discontinue providing service to the Beta Software at any time.
10. Finqalab makes no guarantee or commitment as to the success of the Beta Software.
11. You acknowledge that the privacy terms set forth or referenced herein WILL NOT apply to beta testing and no privacy or security should be reasonably expected during beta testing. The use of the Beta Software for the purposes of Beta testing is entirely at your risk and not Finqalab.
12. Finqalab shall not be liable for any lost revenue, lost profits, or other incidental or consequential damages even if advised of the possibility of such damages by reason of any performance or non-performance under these Terms and Conditions.
13. Furthermore, Finqalab shall not be liable for any delays, losses, or other damages which may result from the furnishing or canceling of any Finqalab software, features, and/or modules, including, but not limited to, the beta testing software.
14. You agree to indemnify and hold Next Capital Limited, its officers, directors and employees harmless from any losses that directly or indirectly result from any third party claims related to the access and use of the Beta Software.
15. Upon reasonable request by Finqalab / Next Capital Limited, you agree to provide suggestions, enhancement requests, and recommendations regarding the Beta Software. Any feedback shall include informing Finqalab / Next Capital Limited about the performance, ease of use, features that may be missing, and any bugs encountered during the use of the Beta Software. Finqalab / Next Capital Limited may contact you and you agree to make available a reasonable amount of time to discuss the Beta Software with Finqalab / Next Capital Limited, if so requested. Finqalab / Next Capital Limited may without restriction or fee use, modify and incorporate this suggestion / feedback / inputs into the Beta Software.
16. Finqalab / Next Capital Limited makes no representations or warranties, express or implied, regarding the Beta Software, including any representation that the services thereunder will be uninterrupted or error-free. For the avoidance of doubt, the Beta Software is in testing phase and is expected to contain defects which may be material, and are not expected to operate at the level of performance or compatibility of a final, generally available product offering. The Beta Software may not operate accurately and may be substantially modified prior to public availability or withdrawn at any time. Accordingly, access to and use of the Beta Software is entirely at your own risk. In no event shall Finqalab / Next Capital Limited be liable for any damage whatsoever arising out of the use of or inability to use the Beta Software, even if Finqalab / Next Capital Limited has been advised of the possibility of such damages. You are advised to safeguard important data, to use caution and not to rely in any way on the correct functioning or performance of any Beta Software.
